IT IS NOT A MEDICAL DEVICE, DOES NOT PROVIDE MEDICAL ADVICE, AND IS NOT A SUBSTITUTE FOR PROFESSIONAL MEDICAL ADVICE, DIAGNOSIS, OR TREATMENT. THE AI-GENERATED MEDICINE DESCRIPTIONS AND HEALTH RECORD SUMMARIES ARE FOR GENERAL INFORMATIONAL PURPOSES ONLY. ALWAYS CONSULT A QUALIFIED HEALTHCARE PROVIDER FOR ANY MEDICAL QUESTIONS OR BEFORE MAKING DECISIONS BASED ON INFORMATION IN THIS APP.

We do not store your payment card details, UPI credentials, or any financial information on our servers. All payment data is handled exclusively by Razorpay in compliance with PCI-DSS standards and RBI regulations.

  • Razorpay disputes: Chargebacks raised without first contacting us may result in account suspension pending investigation.

5.7 Free Trial

We may offer a free trial of Premium features from time to time. Any such trial will be clearly communicated in the App with the trial duration and what happens at the end of the trial period. You will not be charged without explicit confirmation of subscription.

6. Content Ownership and Licences

6.1 Your Content

You retain full ownership of all Content you upload, enter, or create in MediDibba, including:

  • Family member profiles and health data
  • Medicine records and inventory
  • Uploaded health record files (prescriptions, lab reports, etc.)
  • Vaccination records
  • Notes and tags you create

By using MediDibba, you grant Qudex a limited, non-exclusive, worldwide, royalty-free licence to store, process, and display your Content solely for the purpose of providing the Services to you. We will never use your health data for any purpose other than delivering the App's features to you.

6.2 Licence Restrictions

The licence you grant us does not permit us to:

  • Sell, rent, or share your Content with third parties for marketing purposes
  • Use your health data to train AI or machine learning models
  • Use your Content for any purpose other than operating MediDibba for you
  • Retain your Content after you delete it or delete your account (subject to reasonable backup purge timelines)

6.3 Qudex Intellectual Property

The MediDibba App, including its name, logo, design, user interface, code, features, and all content created by Qudex (such as the AI-generated medicine descriptions in general), is the intellectual property of Qudex and is protected by applicable Indian intellectual property law.

These Terms do not grant you any right, title, or interest in the App beyond the limited licence to use it as described above. You may not:

  • Copy or reproduce the App’s design, interface, or code
  • Use the MediDibba name or logo without our written permission
  • Create derivative works based on the App

6.4 Feedback

If you submit feedback, suggestions, or ideas about MediDibba to us, you grant Qudex a perpetual, irrevocable, worldwide, royalty-free licence to use that feedback for any purpose, including improving the App, without any obligation to compensate you.

7. AI Features and Third-Party Processing

7.1 Medicine Scanning

Scanning reads the printed text on a photo of medicine packaging using Google Gemini. The photo is cropped and reduced on your device before it is sent. By using this feature:

  • You consent to the transmission of that photo to Google servers for processing
  • You understand that accuracy depends on image quality, lighting, and print clarity
  • Results may be inaccurate. Always verify extracted medicine names and expiry dates before saving. An incorrectly extracted expiry date could give you a false sense of security about a medicine’s validity.
  • We are not liable for any harm arising from acting on inaccurate scan output

7.2 AI Medicine Descriptions

Medicine descriptions, read from the scanned photo by Google Gemini, are:

  • Provided for general informational purposes only
  • Not reviewed or verified by licensed medical professionals
  • Not a substitute for reading the medicine’s official package insert (leaflet)
  • Not a substitute for advice from a qualified pharmacist or doctor
  • Generated from the packaging alone, without regard to your personal health profile — potential drug interactions are NOT assessed by this feature

AI-generated descriptions in MediDibba are informational summaries only. They do not account for your personal medical history, other medications, or individual health conditions. Always read the medicine package insert and consult your doctor or pharmacist before taking any medication.

7.3 Reading Uploaded Documents

When you upload a health record and leave "Read this document with AI" ticked, the document is sent to Google Gemini and read in full. Images are sent as a picture; PDFs and Word files are sent as the text extracted from them. The test values, dates, doctor, hospital and medicines it finds are saved to that record and become available to the assistant. By using this feature:

  • You consent to the transmission of that document to Google servers for processing
  • You understand that a scanned PDF containing no text layer cannot be read this way, and will be saved without extracted values
  • Extracted values may be inaccurate, incomplete, or attributed to the wrong test. They are not a substitute for reading the original document.
  • Extracted values are never to be used for medical decision-making

You can turn this option off for any upload. The file is then stored without being sent to an AI provider, and the assistant cannot answer questions about its contents.

7.4 The Assistant

The in-app assistant answers questions using OpenAI GPT-4o mini, reached through OpenRouter. To answer, it is sent the health record of the family member you have selected — their name, age, gender, blood group, allergies, conditions, medicines, reminder times, recent dose history, vaccinations and the contents of their uploaded reports. Answers are:

  • Informational only, and not medical advice
  • Not reviewed by a licensed medical professional
  • Not a diagnosis, and not a basis for starting, stopping or changing any medicine
  • Capable of being wrong about your own record, including misreading a value or a date

Which AI model serves each feature is configured by us and may change without notice, including to a different provider. The providers in use are listed in the Privacy Policy.

7.5 Third-Party Service Terms

Your use of AI features is subject to the terms and policies of the following third parties:

  • Google (Gemini and Firebase): policies.google.com/terms
  • OpenRouter: openrouter.ai/terms
  • OpenAI: openai.com/policies/terms-of-use
  • Supabase: supabase.com/terms
  • Resend: resend.com/legal/terms-of-service
  • Razorpay: razorpay.com/terms
  • Expo: expo.dev/terms

We are not responsible for the availability, accuracy, or conduct of third-party services. Their service interruptions may affect App functionality.

8. Disclaimers and Limitation of Liability

8.1 Disclaimer of Warranties

MEDIDIBBA IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. QUDEX DOES NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF VIRUSES. WE DO NOT WARRANT THE ACCURACY, COMPLETENESS, OR RELIABILITY OF ANY AI-GENERATED CONTENT, SCAN OUTPUT, OR OTHER INFORMATION IN THE APP.

8.2 No Medical Advice

Nothing in MediDibba constitutes medical advice, diagnosis, or treatment. MediDibba is a personal information management tool. Qudex is a technology company, not a healthcare provider. We strongly encourage all users to consult qualified healthcare professionals for any health concerns.

8.3 Data Loss

While we implement robust backup and sync mechanisms, we cannot guarantee that your data will never be lost. We strongly recommend:

  • Keeping original physical copies of important prescriptions, lab reports, and discharge summaries
  • Not relying solely on MediDibba as the only record of critical health information
  • Ensuring your device is charged and the App is synced before travelling or during emergencies

8.4 Emergency Card Limitation

The Emergency Card feature displays health data that you have entered into the App. Its accuracy depends entirely on the accuracy of the data you have entered and how recently it has been updated. Qudex is not liable for:

  • Incorrect health information displayed on the Emergency Card due to outdated or inaccurate user-entered data
  • The Emergency Card being unavailable due to device failure, battery drain, or software error
  • Any medical outcome arising from reliance on Emergency Card information

8.5 Limitation of Liability

To the maximum extent permitted by applicable Indian law, Qudex's total liability to you for any claim arising out of or related to these Terms or your use of MediDibba shall not exceed the total amount you have paid to Qudex in the 12 months immediately preceding the event giving rise to the claim. If you have not paid us anything, our total liability shall not exceed INR 500.

In no event shall Qudex be liable for:

  • Indirect, incidental, special, consequential, or punitive damages
  • Loss of data, loss of profits, or loss of goodwill
  • Damages arising from your reliance on AI-generated descriptions, extracted document values, assistant answers, or scan output
  • Damages arising from third-party service failures (Supabase, Google, OpenRouter, OpenAI, Resend, Razorpay, Expo)
  • Any medical harm arising from the use of or reliance on MediDibba

These limitations apply regardless of the form of action and even if Qudex has been advised of the possibility of such damages. Some jurisdictions do not allow limitation of liability for personal injury or certain types of damages; in such cases, our liability is limited to the maximum extent permitted by law.

9. Indemnification

You agree to indemnify, defend, and hold harmless Qudex, its members, developers, agents, and representatives from and against any and all claims, damages, losses, costs, and expenses (including reasonable legal fees) arising from or related to:

  • Your use of MediDibba or the Services
  • Your violation of these Terms
  • Your violation of any applicable law or regulation
  • Any Content you upload or enter into the App that infringes the rights of a third party
  • Your sharing of access to your account with another person
  • Health data you enter for family members who have not consented to such data being stored

Qudex reserves the right to assume exclusive defence and control of any matter subject to indemnification by you, in which case you agree to cooperate with us in asserting available defences.

10. Account Suspension and Termination

10.1 Termination by You

You may stop using MediDibba at any time by:

  • Deleting the App from your device
  • Requesting account deletion by emailing legal@medidibba.com with the subject "Account Deletion Request"

Upon account deletion, all your data will be permanently deleted from our servers within 30 days. Backup copies will be purged within 60 days. Local SQLite data on your device is deleted when you uninstall the App.

10.2 Termination by Qudex

We reserve the right to suspend or terminate your account, with or without notice, if we have reason to believe you have:

  • Violated these Terms of Use
  • Provided false information during registration
  • Used the App in a way that is harmful to other users or to Qudex
  • Engaged in fraudulent activity, including fraudulent chargebacks
  • Used the App for any commercial, professional, or enterprise purpose without authorisation
  • Attempted to compromise the security or integrity of the App or its infrastructure

10.3 Effect of Termination

Upon termination of your account for any reason:

  • Your licence to use the App immediately terminates
  • Access to all your stored data will be revoked
  • Any active Premium subscription will be cancelled without refund for the remaining period (if terminated for breach)
  • Sections of these Terms that by their nature should survive termination (including disclaimers, limitation of liability, and governing law) will survive

10.4 App Discontinuation

Qudex reserves the right to discontinue MediDibba at any time with 60 days advance notice to registered users. In the event of discontinuation:

  • We will provide a data export tool allowing you to download all your data in JSON format
  • Any prepaid Annual Premium fees will be refunded on a pro-rata basis for the unused period
  • We will maintain read-only access to the App for 60 days after the discontinuation notice

11. App Updates and Changes to Services

11.1 App Updates

We may release updates to MediDibba from time to time via the Google Play Store and Apple App Store, or via Expo's Over-The-Air (OTA) update mechanism. Updates may:

  • Add new features or improve existing ones
  • Fix bugs or security vulnerabilities
  • Modify or remove existing features
  • Change the App’s technical architecture

We strongly recommend keeping the App updated to the latest version. We may discontinue support for older versions of the App, and some features may not function correctly on outdated versions.

11.2 Changes to These Terms

We may modify these Terms of Use at any time. When we make material changes, we will:

  • Update the "Effective date" at the top of this document
  • Send an in-app notification describing the key changes
  • Post the updated Terms at https://medidibba.com/terms

Material changes (such as changes to your rights, fees, or liability provisions) will be communicated with at least 30 days advance notice. Your continued use of MediDibba after the effective date of the revised Terms constitutes your acceptance of the changes.

11.3 Changes to Free Tier Limits

We reserve the right to change the free tier limits (member count, scan quota, storage) with 30 days notice. Existing free tier users will be grandfathered at their current limits for 90 days after any reduction in free tier limits.

12. Governing Law and Dispute Resolution

12.1 Governing Law

These Terms and your use of MediDibba are governed by and construed in accordance with the laws of the Republic of India, including but not limited to the Information Technology Act, 2000 and the Consumer Protection Act, 2019, without regard to conflict of law principles.

12.2 Informal Resolution

Before initiating any formal dispute process, you agree to first attempt to resolve any dispute informally by contacting us at legal@medidibba.com. We will attempt to resolve the dispute within 30 days of receiving your complaint.

12.3 Arbitration

If informal resolution fails, any dispute, controversy, or claim arising out of or relating to these Terms, or the breach, termination, or validity thereof, shall be referred to and finally resolved by arbitration under the Arbitration and Conciliation Act, 1996 (India). The seat of arbitration shall be India. The arbitration shall be conducted in the English language.

The arbitrator's award shall be final and binding. Nothing in this clause shall prevent either party from seeking urgent injunctive relief from a court of competent jurisdiction to protect its intellectual property rights or confidential information.

12.4 Jurisdiction

For any matter that cannot be resolved by arbitration, or for enforcement of an arbitral award, you agree to submit to the exclusive jurisdiction of the courts located in India. If Qudex's members are spread across multiple cities, the jurisdiction shall be determined by the location of the lead developer as notified to you.

12.5 Class Action Waiver

You agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action. You waive any right to bring or participate in a class action lawsuit or class-wide arbitration against Qudex.

13. General Provisions

13.1 Entire Agreement

These Terms, together with the Privacy Policy and any additional terms applicable to specific features (such as the Premium subscription terms), constitute the entire agreement between you and Qudex regarding your use of MediDibba and supersede all prior and contemporaneous agreements, representations, and understandings.

13.2 Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions will continue in full force and effect. The invalid provision will be modified to the minimum extent necessary to make it enforceable.

13.3 Waiver

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. A waiver of any breach or default will not constitute a waiver of any subsequent breach or default.

13.4 Assignment

You may not assign or transfer your rights or obligations under these Terms without our prior written consent. We may assign our rights and obligations under these Terms to a successor entity in the event of a merger, acquisition, or sale of all or substantially all of our assets, with notice to you.

13.5 Force Majeure

Qudex shall not be liable for any failure or delay in the performance of our obligations under these Terms due to causes beyond our reasonable control, including but not limited to: acts of God, natural disasters, pandemic, government action, internet outages, third-party service failures (including Supabase, Google Cloud, or Razorpay outages), power failures, or civil unrest.

13.6 No Partnership

Nothing in these Terms creates a partnership, joint venture, agency, franchise, or employment relationship between you and Qudex. You have no authority to make any representations or commitments on behalf of Qudex.

13.7 Language

These Terms are written in English. In the event of any conflict between an English version and a translated version of these Terms, the English version shall prevail.

13.8 Notices

All legal notices to Qudex must be sent by email to legal@medidibba.com. Notices will be deemed received 24 hours after the email is sent, provided no delivery failure notification is received. We may send notices to you via the email address associated with your Google Account or via in-app notifications.
